- Many salon owners unknowingly violate worker’s rights. And here is the scary part… that makes you very vulnerable and an easy target for government audits that carry substantial and severe financial penalties whether you are aware of them or not.

I am always amazed how many hair stylists and salon owners who go into chat rooms looking for or giving legal information and advice without any proper legal education about labor laws in your specific to your state.

You should only seek legal information from a labor law attorney in your own state, which will help you avoid any government penalties and fines and protect your business.
$$$$ Did you know… Recently a salon was hit with a whopping fine of 1.3 million dollars? Just for mis-classifying their employees as independent contractors?
Here is how you can take preventative action to protect yourself and your business. It is just self-care for yourself as entrepreneur.
For example, In the State of California, the State Supreme Court has created a new law helping salon owners understand what classifies an employee vs. an independent contractor, so it is more clear and simpler to calculate for both owner, and worker.
It is called the ABC Test which makes it tougher for salon owners to rent out booth space by muddying the waters in trying to classify workers legally, and safely. This can help you better determine, and with more confidence and understanding of the law regarding to worker employment status.
Let’s talk about some of the areas that are potential issues
Some of the areas in question, which can lead to owner responsibility for labor law violations in their salons. They can include:
- Minimum Wage
- Overtime Calculations / Requirements
- Rest breaks
- Lunch Breaks
- Tip Compliance
- Booth Rentals penalties by misclassifying your workers, Beware of our new labor laws
And other conditions and clarifications as determined by your governing agencies.
Jon says…So if you rent out booth space in your salon and/or hire employees, please take care of yourself first, and make sure that your business is in compliance with the new laws in your state.
These new California State Labor Laws are extremely complex, and in my humble opinion, unfair for salon owners just trying to make a living and offer worker’s opportunities for make money.
Here is A Big Word of Warning to Salon Owners
It is even more scary, that many of these regulatory government agencies and attorneys who specialize in protecting the rights of employees are encouraging workers to see out financial damages from their salon owners when they feel their worker rights are being violated and take the lead in making sure they know they can receive representation and legal action and/or advice against salon owners.
Although this new law applies only to the State of California at this time. I want to encourage salon owners across the country to seek information. California is know to be a very progressive leader in state laws concerning worker’s rights and acceptable working conditions. It is also often is a catalyst for other states to consider such new rulings in labor laws. Many states are also following California’s
lead on this topic.
As a smart business owner, it is important, and worth your time and financial investment in your business to keep up with these ever-upgrading and changing laws for the beauty industry, we all love and care about.

Protect yourself and your companies by seeking legal assistance to help you understand the labor laws affecting your business.
If you are concerned or not sure that you are mis-classifying workers, you need to change your company policies and procedures, and fast! Claiming ignorance of the law is not an excuse that will protect you from governmental agencies and frustrated workers.
So here are the short and fast suggestions to protect both yourself and the rights of your workers:
- Understand the Worker Rights in your State and keep up with new information in this area.
- Talk with a Labor Law Attorney who specializes in protecting your rights as an employer in your area who can provide expert and up-to-date advice and clarification. Defend My Business is an excellent site that protects your rights as an employer.
- Create or upgrade your Worker Policies and Procedures Manual and keep it legally current with new laws in your area. Have your Labor Law attorney review your manual for accuracy and protection.
- Join a Salon Owner’s Organization, which can give you rights or representation at the state governmental level because now, we have no state presentation to have our opinions including in laws that govern us.
